Expungement Assistance for Eligible Misdemeanors & Eligible Felonies

Welcome to the Clear Path Expungement Project Case Review process.  Here, we want to ensure you understand the importance of familiarizing yourself with the requirements of expungement and the types of assistance we offer.  If we review your case and determine we can assist you, you will be scheduled for  Expungement processing, where our team will assist you in completing your required Expungement paperwork.

Please note that you must meet the requirements below, upload your authorized background records with a completed Expungement Intake Form, and submit payment of $85 all at once, BUT FIRST YOU HAVE TO MAKE SURE YOU QUALIFY!  Please see below.

Record Sealing vs. Expungement

Record Sealing = case is hidden from public view (most employers, landlords, licensing boards cannot see it)
Expungement = record is destroyed and treated as if it never occurred
Most people qualify for record sealing first, then expungement later.

Steps for Expungement
Case Review for Cleveland, OH

  1. Case must be Non-violent

  2. No Sex Offender Cases 
  3. No outstanding restitutions
  4. No outstanding court cases
  5. No open cases
  6. No outstanding fines
  7. No out of state cases
    (all out of state cases have to be dealt with first)
  8. Non-sexual F4 or F5 felonies (including most drug trafficking/ possession cases) are generally eligible for record relief
  9. Ohio now allows unlimited F4 & F5 convictions to be sealed if non-violent
  10. For non-violent F4/F5 convictions, the Court will still evaluate based upon:

    Rehabilitation (document your positive rehab)
    Community safety (document how you're not a threat to society)
    Order probation department background check
    Review criminal history
    Consider employment, housing, rehabilitation

  11. Your waiting period has to have already been completed for all case types
  12. If you have multiple Felony 4's and Felony 5's, they may be able to be sealed, but the Court still will be checking on your:

    Rehabilitation
    Community safety
    Objections from prosecutor

  13. Go to Justice Center, 1200 Ontario Street, Cleveland, OH  44113
  14. Go to 3rd Floor
  15. Go to Arrests & Warrants Window
  16. Ask for your “City Records” – FREE
  17. Go to Sheriff’s Department Window
  18. Ask for your Cuyahoga County Criminal Records Cost is $6.00
  19. DO NOT LEAVE YET THE CRIMINAL RECORDS WINDOW YET BEFORE....
  20. Check for your journal entries

  21. Get Your Final Discharge Date:
    This is the date probation ended and all financial obligations were paid

  22. As you begin your Expungement process, please pay close attention to the docket.  Access the docket website at:  
    https://cpdocket.cp.cuyahogacounty.gov
  23. You need to answer the Objection by filing a response to Prosecutor’s Objection in writing & request for hearing.
  24. Expungement documentation is required to  be filed in the same court where the conviction occurred and the following documents are required:
    Application for Record Sealing (or Expungement)
    Case numbers

  25. Filing fee (~$50+ for convictions)
